1. Overview & Acceptance of Terms

By using joharmarketing.com or entering into a service agreement with Johar Marketing (“we,” “us,” or “our”), you (“Client,” “User”) accept and agree to these Terms & Conditions. If you do not agree, you must refrain from using our website or services.


2. Services Offered

Johar Marketing provides digital marketing and creative services, including but not limited to:

  • Digital Marketing & Performance Meta Ads

  • Social Media Management

  • WordPress Website Development & Maintenance

  • AI Automation & Integration

  • Graphic Design & Branding

  • Video Editing & Content Creation

  • Custom Special Designs & Marketing Solutions

Detailed scopes of work, deliverables, and timelines will be specified in individual proposals, quotes, or statements of work (SOW) provided to the Client.


3. Client Responsibilities

To enable Johar Marketing to deliver quality work on schedule, the Client agrees to:

  • Provide Required Assets: Supply necessary text, images, logos, brand guidelines, or account credentials promptly upon request.

  • Grant Access: Provide access to relevant platforms (e.g., Google Analytics, Meta Business Manager, WordPress Admin) as needed for service delivery.

  • Timely Feedback: Review and approve deliverables or provide feedback within agreed timeframes (typically 3–5 business days) to prevent project delays.


4. Payments, Billing & Refunds

  • Payment Terms: Services are billed as outlined in your invoice or contract (e.g., upfront payment, milestone payments, or recurring monthly retainers).

  • Late Payments: Invoices not settled by the due date may result in a temporary suspension of work or ad campaign management until cleared.

  • Ad Spend: Ad spend paid directly to third-party ad networks (e.g., Meta, Google) is separate from Johar Marketing’s service fees.

  • Refund Policy: Due to the custom, labor-intensive nature of our digital marketing, development, and design services, fees paid for completed work or ongoing monthly retainers are non-refundable unless explicitly stated in writing.


5. Intellectual Property Rights

  • Final Deliverables: Upon full payment of all invoices, the Client owns the final approved graphics, website designs, videos, or marketing materials created specifically for them.

  • Pre-existing & Source Materials: Johar Marketing retains ownership of internal tools, templates, proprietary code, AI workflows, and unselected draft designs.

  • Portfolio Usage: Johar Marketing reserves the right to display completed project work, logos, and case studies on joharmarketing.com and social media channels for promotional purposes, unless a Non-Disclosure Agreement (NDA) specifies otherwise.


6. Scope Changes & Revisions

  • Each project includes a specified number of revision rounds as defined in the project scope.

  • Requests for major structural changes, additional features, or out-of-scope tasks will be billed separately at our standard hourly or project rate upon client approval.


7. Limitation of Liability & Third-Party Platforms

  • Performance Disclaimer: While we use industry best practices to maximize campaign performance and reach, Johar Marketing cannot guarantee specific sales figures, ROI, or viral reach, as performance depends on market variables and third-party algorithm updates.

  • Third-Party Suspensions: Johar Marketing is not responsible for policy enforcement, account suspensions, or downtime imposed by external platforms (e.g., Meta, Google, hosting providers, or WordPress plugin developers).

  • Maximum Liability: To the maximum extent permitted by law, Johar Marketing’s total liability for any claim shall not exceed the total amount paid by the Client to Johar Marketing for the specific service in question.


8. Confidentiality & Data Protection

Both parties agree to protect and keep confidential all non-public, proprietary information shared during the course of the business relationship. Personal data collected via our website will be handled in accordance with our Privacy Policy.


9. Cancellation & Termination

  • One-Time Projects: Either party may terminate a project agreement with written notice. In the event of early termination, the Client is responsible for paying for all work completed up to the termination date.

  • Monthly Retainers: Monthly recurring services require a 30-day written notice prior to the next billing cycle for cancellation.


10. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of [Your Country / State], without regard to its conflict of law provisions.
